This website is operated by Grateful Glass & Display LLC, doing business as The Online Paperweight Shop. Throughout this website, the terms “we,” “us,” and “our” refer to The Online Paperweight Shop.

We operate this website and store, including all related information, content, features, tools, products, and services, to provide customers with a curated online shopping experience. The store is hosted and powered by Shopify.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, International Orders Policy, Damaged or Lost Packages Policy, and any other policies posted on this website, govern your access to and use of the website and your purchases from us.

By visiting the website, using any part of the website, creating an account, or placing an order, you agree to these Terms of Service. If you do not agree to these Terms, do not use the website or place an order.

Nothing in these Terms limits any consumer rights that cannot legally be waived under applicable law.

Section 1 — Eligibility and Website Access

You must be at least the age of majority in your state, province, or country of residence to place an order through this website.

You may permit a minor dependent to view the website using a device that you own or control, but products may only be purchased by an adult legally capable of entering into a binding agreement.

You agree to use the website only for lawful purposes and in compliance with these Terms.

We may suspend, restrict, or terminate access to the website when reasonably necessary to protect the store, its customers, its service providers, or other persons.

Section 2 — Customer Accounts

You may be permitted to create a customer account. You are responsible for providing current, complete, and accurate information and for maintaining the confidentiality of your login credentials.

You are responsible for activity conducted through your account unless the activity results from a security failure within our control.

You must promptly notify us if you believe that your account has been accessed or used without authorization.

We may cancel or restrict an account that contains materially inaccurate information, is being used unlawfully, or is being used in violation of these Terms.

Section 3 — Products and Product Descriptions

We sell collectible glass paperweights and may also sell other glass objects, display accessories, merchandise, and related items.

Our inventory may include:

  • Newly produced artist paperweights and glass objects

  • Antique, vintage, previously owned, or collector-market items

  • Limited editions, collaborations, prototypes, and one-of-a-kind objects

  • Related merchandise and display accessories

We make reasonable efforts to describe and photograph each product accurately. Product descriptions, photographs, dimensions, condition statements, maker information, dates, signatures, canes, markings, and provenance information form part of the product listing.

Because many products are handmade, antique, vintage, or previously owned, variations and imperfections may occur. These may include bubbles, tool marks, pontil marks, slight asymmetry, surface wear, scratches, shelf wear, manufacturing variations, or other characteristics associated with handmade production, age, and previous ownership.

Known material condition issues will be disclosed when reasonably identifiable during inspection.

Colors and details may appear differently depending on lighting, photography, screen settings, and the device used to view the website. Measurements are approximate unless expressly stated otherwise.

Descriptions concerning artist, maker, factory, date, attribution, or provenance reflect our good-faith assessment based on available markings, records, provenance, comparison, and professional knowledge. Customers should contact us before purchasing when a particular attribution, date, condition detail, or measurement is essential to their decision.

Section 4 — Product Availability

Many products offered through the website are unique or available in quantities of one.

Placing a product in a shopping cart does not reserve it. A product may remain available for purchase by another customer until checkout is completed and the order is accepted.

Inventory errors, simultaneous purchases, damage discovered during final inspection, or prior off-site sales may occasionally make a product unavailable after an order is submitted.

If we cannot fulfill an order, we will cancel the affected item and refund the amount paid for that item. We are not responsible for additional costs or losses resulting from an unavailable item beyond refunding the payment received.

We may limit quantities, discontinue products, or withdraw listings at any time.

Section 5 — Orders and Acceptance

Submitting an order constitutes an offer to purchase the listed products under these Terms.

An automated order confirmation acknowledges that we received the order. It does not necessarily constitute final acceptance of the order.

An order is accepted when we confirm that it will be fulfilled or when the order is shipped, whichever occurs first.

We reserve the right to refuse or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Inventory or pricing errors

  • Suspected fraud or unauthorized payment

  • Incomplete or inaccurate customer information

  • Shipping restrictions

  • Violation of these Terms

  • Discovery of previously unidentified damage or a material listing error

If we cancel a paid order, we will refund the amount collected for the canceled portion.

Please review the order, delivery address, and contact information carefully before submitting payment. We may be unable to change or cancel an order after processing begins.

Section 6 — Prices and Payment

Prices are displayed in the currency selected or presented through the website.

Depending on your location, Shopify Markets, your payment provider, or another service provider may display or process a converted currency amount. Currency exchange rates and conversion fees may be determined by Shopify, the payment processor, or your financial institution.

The final amount charged will be shown during checkout before the order is submitted.

We reserve the right to change product prices at any time before an order is accepted. A later price change does not affect an order that has already been accepted.

Payment must be successfully authorized before an order is fulfilled.

You represent that:

  • The payment information you provide is accurate

  • You are authorized to use the selected payment method

  • You will pay all charges associated with the order

  • The billing information provided matches the information required by the payment provider

We do not directly store complete payment-card information. Payment processing is provided through Shopify and its authorized payment providers.

Section 7 — Taxes, Duties, and Import Charges

Applicable sales taxes may be calculated and collected during checkout based on the order and delivery location.

International customers are responsible for customs duties, import taxes, brokerage charges, handling charges, and other governmental or carrier-imposed fees unless checkout expressly states that those charges are included.

These charges are not controlled by The Online Paperweight Shop and may be collected separately by a carrier, customs authority, government agency, or other party.

Refusal to pay customs or import charges does not automatically entitle the customer to a full refund. Any return resulting from refused delivery will be handled under our applicable policies, and actual shipping, customs, carrier, or return expenses may be deducted where legally permitted.

Section 8 — Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy and the shipping terms displayed during checkout.

Processing and delivery estimates are estimates only and are not guaranteed delivery dates.

Delivery time may be affected by carrier delays, weather, customs processing, holidays, incorrect addresses, service disruptions, or other circumstances outside our reasonable control.

The customer is responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address, refused shipment, or unsuccessful delivery attempt may be charged to the customer where legally permitted.

Tracking information will be provided when available.

Special delivery instructions or carrier requests should be submitted before an order is placed. We cannot guarantee that every special request can be accommodated.

Section 9 — Risk of Loss and Delivery

Risk of loss will transfer as provided by applicable law.

A carrier’s tracking record showing delivery may be considered evidence of delivery, subject to our Damaged or Lost Packages Policy and any rights available under applicable law.

Customers should promptly inspect packages after delivery and report visible damage, missing items, or other delivery problems.

Customers must retain the item, shipping box, packing materials, and shipping label while a damage or loss claim is being reviewed.

Section 10 — Damaged or Lost Packages

Claims involving damaged, missing, or lost shipments are governed by our Damaged or Lost Packages Policy.

A customer reporting damage may be required to provide:

  • The order number

  • Photographs of the product

  • Photographs of the shipping box

  • Photographs of the interior packing materials

  • A photograph of the shipping label

  • Other information reasonably required by the carrier or insurer

Customers must cooperate with reasonable carrier and insurance claim requirements.

A resolution may include a refund, repair, replacement, or another appropriate remedy depending on the circumstances, availability of the product, carrier findings, insurance requirements, and applicable law.

Because many products are unique, an identical replacement may not be available.

Section 11 — Returns, Exchanges, and Refunds

Returns, exchanges, cancellations, and refunds are governed by our Refund Policy.

Unless required by law or stated otherwise in the Refund Policy:

  • New paperweights may be eligible for return within 14 days of delivery when unused and returned in their original condition.

  • Antique, vintage, used, or previously owned paperweights may be eligible for return within seven days of delivery when the item is materially not as described or arrives damaged.

  • Other new glass products may be eligible for return within 14 days of delivery when unused and returned in their original condition.

A return must be authorized before it is shipped back.

Customers must package returned glass securely. The customer may be responsible for loss or damage occurring during unauthorized or inadequately packaged return shipping.

Refunds are issued after the returned product is received and inspected.

Original and return shipping charges are nonrefundable unless the item was defective, materially misdescribed, damaged in transit, or applicable law requires otherwise.

A refund may be reduced if a returned item has been used, altered, damaged, incompletely returned, or returned in a condition different from the condition in which it was delivered, to the extent permitted by law.

Section 12 — Promotions, Discounts, and Gift Cards

Promotional offers, discount codes, store credits, and gift cards are subject to any terms displayed with the offer.

Unless expressly stated otherwise:

  • Discounts cannot be combined

  • Discounts have no cash value

  • Discounts cannot be applied retroactively

  • Discounts may exclude certain products or collections

  • Discounts may be limited to one use per customer or order

  • Expired promotions will not be honored

We may correct, suspend, or cancel a promotion that contains an error, is being misused, or is affected by fraud or technical malfunction.

Gift cards and store credits are governed by the terms presented when issued and by applicable law.

Section 13 — Accuracy of Website Information

We make reasonable efforts to keep website information accurate and current. However, the website may occasionally contain typographical errors, omissions, outdated information, incorrect prices, inventory errors, or inaccurate product details.

We may correct errors, update information, or cancel an affected order when a material error is discovered.

Historical, educational, artist, or collector information provided on the website is offered for general informational purposes and should not be treated as a substitute for independent appraisal, authentication, investment, tax, legal, or insurance advice.

Section 14 — Personal Use and Prohibited Conduct

You may use the website and its content for lawful personal shopping and informational purposes.

You may not use the website:

  • For unlawful, fraudulent, deceptive, or malicious purposes

  • To violate intellectual-property, privacy, publicity, or other legal rights

  • To submit false or misleading information

The sale of a physical product does not transfer copyright, trademark, reproduction, merchandising, licensing, or other intellectual-property rights unless a separate written agreement expressly states otherwise.

You may not reproduce, publish, distribute, modify, sell, license, or commercially exploit website content without written permission from the applicable rights holder.

Product photographs may not be copied or used to advertise another item without prior written authorization.

Section 16 — Reviews, Messages, and Customer Submissions

If you submit a review, photograph, comment, suggestion, message, or other content, you represent that:

  • You have the right to submit it

  • It is accurate to the best of your knowledge

  • It does not violate another person’s rights

  • It is not unlawful, threatening, defamatory, obscene, fraudulent, or malicious

  • It does not contain malware or harmful code

You retain ownership of your original content.

Section 19 — Relationship With Shopify

The Online Paperweight Shop uses Shopify to host and operate the online store.

Any purchase made through this store is a transaction directly between the customer and Grateful Glass & Display LLC, doing business as The Online Paperweight Shop.

Shopify is not the seller of the products offered by The Online Paperweight Shop and is not responsible for the description, quality, condition, fulfillment, delivery, return, or use of those products.

Shopify may process information and provide services necessary to operate the store, checkout, payment systems, customer accounts, fraud screening, analytics, and other store functions.

Use of Shopify-operated features may also be subject to Shopify’s applicable terms and privacy notices.

Section 20 — Privacy

Our collection, use, storage, processing, and disclosure of personal information are governed by our Privacy Policy.

Information submitted through the website may be transmitted to Shopify, payment providers, shipping carriers, fraud-prevention services, technology providers, and other service providers as reasonably necessary to operate the store and fulfill orders.

You are responsible for reviewing the Privacy Policy before using the website or submitting personal information.

Section 21 — Disclaimer of Warranties

We make reasonable efforts to operate the website accurately and reliably.

However, except for express product commitments stated in a listing or policy, and to the fullest extent permitted by law, the website and its services are provided on an “as available” basis.

We do not guarantee that:

  • Website access will always be uninterrupted or error-free

  • Every technical problem will be corrected immediately

  • Every product will remain available

  • Website content will be free from every error

  • A particular product will increase in value

To the fullest extent permitted by applicable law, Grateful Glass & Display LLC, The Online Paperweight Shop, and their owners, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or purchase of a product.

This may include lost profits, lost revenue, lost savings, lost data, loss of use, or replacement expenses, except where liability cannot legally be limited.

For a claim directly related to a purchase, our aggregate liability will not exceed the amount actually paid for the product giving rise to the claim, except where applicable law requires a different remedy.

These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, or other circumstances for which limitation is prohibited by law.

Section 23 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Grateful Glass & Display LLC, The Online Paperweight Shop, and their owners, employees, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal expenses arising from:

  • Your material violation of these Terms

  • Your unlawful use of the website

  • Your infringement of another person’s rights

  • Content you knowingly submit in violation of these Terms

  • Fraudulent or unauthorized conduct attributable to you

This section does not require a consumer to indemnify us for our own negligence, misconduct, or violation of law.

Section 24 — Severability, Waiver, and Entire Agreement

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed when necessary.

The remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

These Terms and the policies incorporated into them constitute the entire agreement concerning use of the website and purchases through the website, except for any separate written agreement signed by an authorized representative of the parties.

If a product listing, checkout term, or store policy contains a more specific provision concerning a particular transaction, the more specific provision will control to the extent of the conflict.

You may not transfer your rights or obligations under these Terms without our prior written consent.

Any dispute that is not resolved informally may be brought in a court with lawful jurisdiction in Massachusetts, subject to any mandatory consumer-protection rights concerning jurisdiction or venue.

Before filing a claim, the parties are encouraged to contact one another and make a reasonable good-faith effort to resolve the dispute.

Nothing in this section prevents either party from seeking relief in small-claims court when eligible or from exercising rights that cannot legally be waived.

Section 27 — Changes to These Terms

We may update these Terms to reflect changes in the website, store operations, products, services, policies, technology, or applicable legal requirements.

The current version will be posted on this page with an updated revision date.

Changes will apply prospectively unless applicable law permits or requires otherwise.
